Outline - Anatomy of an Immigration Negligence Case

In the ever-expanding realm of negligence claims against immigration professionals, this is a MUST for all practitioners!

This dynamic program will review the elements of negligence in immigration cases as litigated in both the Federal Court and civil courts.  Attendees will learn the following:

* A review of the basic elements of negligence - duty of care, standard of care and damages.

* What evidence is required to establish negligence?

* Key professional requirements such as “competency”, “honesty” and “reasonable fees”. 

* Code of Conduct provisions pertaining to fraud and negligence.

* Federal Court jurisprudence on the “ineffective assistance of counsel”.

* The intersection between Federal Court decisions and civil actions for negligence in immigration cases.

* Being aware of the increase of civil proceedings against immigration professionals and how it can affect you.

*  The risks of using AI in your immigration submissions and the potential for sanction by either your regulator, the Federal Court, or both. 

* Consideration of fact patterns based upon actual civil court actions against immigration professionals.

Eoin Logan LL.M.

Eoin Logan and his team assist clients with various litigation matters, and his main focus is professional negligence claims against immigration consultants and immigration lawyers. Eoin has extensive experience working with clients throughout the Lower Mainland. He regularly advises on and litigates claims in negligence against immigration professionals in the Supreme Court of BC. Eoin has conducted numerous trials achieving successful results for his clients and approaches his files from a practical perspective.

Throughout the years, Eoin has frequently volunteered to help community organisations and new immigrants to Canada. Eoin sits on the board of directors for the Ireland-Canada Chamber of Commerce. He is a member of the CILA Ethics committees for immigration lawyers in Canada and he sits on the Migrant Worker’s Centre ‘Legal Action Committee’ which discusses trends in the legal rights of new immigrants to Canada. Eoin is a regular volunteer with Irish community events in the Lower Mainland and regularly hosts visiting Irish politicians.

Eoin has been a speaker at professional development events for the CBA, CILA and IMM Seminars. He also appeared on an episode of the Borderlines Podcast explaining his work in relation to immigration negligence. Eoin enjoys dedicating time to educate the public and business community on how negligence in an immigration practice can lead to potential civil liability. He lives in Tsawwassen with his wife, son and dog Stevie, When Eoin isn’t walking the dog or at an Irish community event, he can be found hiking up or snowboarding down the local mountains

Lynn Gaudet B.A., LL.B. RCIC

Lynn is a Regulated Canadian Immigration Consultant (RCIC) who operated her own business as a sole practitioner in Calgary, AB for 17 years from 2004-2021, is now semi-retired in Nanaimo, BC. Her practice areas spanned a broad spectrum of immigration and refugee applications with a focus on Permanent Resident applications and criminal inadmissibility issues. She also has decades of experience in adult education - teaching, writing and developing instructional materials such as the Immigration Practitioner’s Handbook published annually by Thomson Carswell Ltd. from 2006-2012.

Lynn is currently an Adjunct Professor in the Faculty of Law at Queens University teaching in the Graduate Program in Immigration and Citizenship Law [GDipICL]. She has taught the Ethics and Professional Responsibility Course for the Program since its inception and has also served as the Coordinating Instructor with responsibility for the curriculum.

She has a B.A. in Communications from Simon Fraser University and an LL.B. from the University of Victoria. She is a licensee in good standing of the College of Immigration and Citizenship Consultants (CICC).  In 2025, she was the recipient of the inaugural award for Teaching Excellence in the Graduate Diploma in Immigration and Citizenship Law at Queen’s University.

César is a Calgary lawyer who, prior to founding Camino Law Group, worked with a regional firm in the areas of personal injury, employment, immigration, and energy and regulation. He has experience advocating for clients in court and in tribunals of different types.

Before becoming a lawyer, César spent close to ten years advocating for immigrants, workers, and vulnerable populations.

César’s professional and legal background led him to found Camino Law Group. Along with Rick La, RCIC, César had a dream to provide quality legal and immigration services to regular people and small businesses.

Cesar’s current practice encompasses immigration litigation before the IRB and Federal Court, civil litigation in the areas of professional negligence, employment, and contractual disputes.  Camino Law Group operates out of Calgary and serves clients from all over the province.  Camino also provides community service through workshops on immigrant and employee rights, and through legal clinics at the Mexican Consulate in Calgary and Centre for Newcomers.  One of the topics Camino focuses on during its public workshops is how to avoid or deal with immigration fraud.
